- As introduced, Nevada
Senate Bill 13 would have made it a crime to send unsolicited
commercial e-mail (UCE) absent a preexisting business
relationship.
- The version passed by the
Senate also prohibited UCE, but would have imposed
civil rather than criminal liability for violations
(recipients could recover $10 or actual damages for each
violation, along with attorney's fees, and could apply
for injunctive relief). The Senate version specifically
exempted ISPs from liability unless they were responsible
for preparing the message.
- The Assembly version of
the bill (reportedly drafted with input from the
Direct Marketing
Association) added another exception, permitting
UCE that is "readily identifiable" as an advertisement
if it includes the sender's name, address, and e-mail
address, along with instructions for opting out of
future messages from the sender.
- The Senate concurred in the Assembly version.
The law takes effect on July 1, 1998.
